Terms of Service
1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of Futio, the web application available at playfutio.com (the “Service”), operated by us (“Futio”, “we”, “us”). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Futio.
You must be able to form a binding contract in your jurisdiction. If you use Futio on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
2. User responsibilities
You agree that you will:
- Use Futio only for lawful purposes and in line with these Terms.
- Provide accurate information where the Service asks for it, and keep your account details reasonably up to date.
- Respect other users: no harassment, hate, threats, discrimination, or intimidation.
- Not misuse the Service—including attempting to break security, overload systems, scrape data you are not permitted to access, or interfere with other users’ experience.
- Understand that organizing and playing football involves real-world risk. You are responsible for your own decisions about participation, health, and safety (see sections 5 and 6 below).
3. Account rules
You are responsible for safeguarding your login credentials and for activity under your account. If you suspect unauthorized access, notify us and change your password where the Service allows.
One person should not maintain multiple accounts to evade restrictions or mislead others, unless we explicitly allow it. We may suspend or close accounts that violate these Terms or put the community at risk.
4. Content and behavior
You may post or submit content through the Service—for example profile information, chat messages, and other inputs the product allows (“Your Content”). You retain ownership of Your Content, but you grant Futio a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute Your Content as reasonably necessary to operate, improve, and secure the Service (including showing it to other users as the product is designed to do).
You must not post content that:
- Is illegal, defamatory, fraudulent, or infringes others’ rights (including privacy and intellectual property).
- Contains malware, spam, or misleading links.
- Sexualizes minors or exploits vulnerable people.
- We reasonably consider harmful to users or the Service.
We may remove content or restrict features where we believe it is necessary for safety, legal compliance, or the integrity of the Service. We are not obligated to monitor all content but may do so where appropriate.
5. Match organization disclaimer
Futio is a coordination tool. It helps people arrange amateur football: rooms, events, registrations, chat, ratings, and related features. We do not organize, supervise, insure, referee, or control real-world matches. Any match, training session, or meet-up is arranged between you and other participants (or organizers you choose), not by Futio.
Futio is not responsible for how matches are run, where they take place, who participates, what rules are followed on the pitch, or any disputes, injuries, losses, or incidents that occur before, during, or after play. That responsibility sits with players, organizers, venues, and any clubs or groups involved—not with Futio.
6. Injuries, conflicts, and real-world incidents
To the fullest extent permitted by law, Futio disclaims responsibility for any injury, illness, death, property damage, theft, assault, verbal or physical conflict, financial loss, or any other harm arising from or related to activities you arrange or join through the Service—including without limitation matches, travel to or from events, social interactions linked to the Service, or decisions made by organizers or participants.
You participate in sport and social activities at your own risk. You should carry appropriate insurance, follow local laws and venue rules, and use good judgment. If a dispute arises between users, you are responsible for resolving it; Futio is not a party to those disputes and does not mediate or adjudicate them, except where we choose to enforce these Terms or protect the Service.
7. Termination
You may stop using Futio at any time. We may suspend or terminate your access if you breach these Terms, if we must comply with law, or if we reasonably need to protect users, the Service, or our operations. We may also discontinue or change the Service with reasonable notice where practicable.
After termination, provisions that by their nature should survive (including disclaimers, limitations of liability, and governing interpretations) will continue to apply.
8. Limitation of liability
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation. To the extent permitted by law, we exclude implied warranties such as merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, Futio and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or revenue, arising from your use of the Service or inability to use it—even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Service or these Terms will be limited to the greater of fifty euros (€50) or the amount you paid us for the Service in the twelve months before the claim (if any). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum extent permitted by law.
9. Changes to terms
We may update these Terms from time to time. We will change the “Last updated” date at the top of this page. If changes are material, we will provide additional notice where appropriate (for example in the app or by email). Continued use of Futio after changes take effect constitutes acceptance of the updated Terms, unless applicable law requires a different process.
